These Terms & Conditions are a legally binding agreement between you and The Anderson Centre LLC, doing business as Coachability (“Coachability”, “we”, “us”). They cover your use of coachability.us, the Coachability Portal and our coaching, training and consulting services. By using our website or portal, or by enrolling in our services, you agree to these terms.

How we collect, use and protect personal information is explained in our Privacy Policy.

1. How These Terms Fit With Your Agreement

If you or your organization signed a coaching agreement, statement of work or other contract with Coachability, that document sets the specific services, fees and commitments. Where it differs from these terms, the signed document applies.

2. Scope of Services

Coachability provides professional coaching, training, workshops and consulting designed to support personal and professional growth. Coaching is a collaborative, thought-provoking process. It is not therapy, and it is not a substitute for advice from a licensed medical, psychological, financial or legal professional. You remain responsible for your own decisions, actions and results, and we do not guarantee specific outcomes.

3. Coaching Ethics

Coachability and its coaches follow the International Coaching Federation (ICF) Code of Ethics. In practice, that means:

  • A clear agreement before coaching starts. Before your first session we agree in writing the services, fees, schedule and the roles of everyone involved, and, for sponsored programs, what your sponsor will see. We keep to that agreement.
  • Confidentiality. What you share in coaching is kept confidential, within the limits explained in our Privacy Policy.
  • The right to end coaching. You, your sponsor or Coachability may end the coaching relationship at any time, for any reason, subject to the notice, cancellation and payment terms of the agreement. You may also ask us to match you with a different coach. If coaching is no longer serving you, your coach will say so and may suggest other support, such as a licensed professional.
  • Conflicts of interest. Coaches tell you about any actual or possible conflict of interest and work it through openly with you, or we offer you a different coach.
  • Honest about roles and qualifications. Coaches describe their qualifications and ICF credentials accurately and work within their competence. If a coach also works in another professional role, for example as a therapist or HR advisor, they tell you whenever they act in that role rather than as your coach.
  • Referrals. If Coachability or a coach would receive or pay a fee or other benefit for a referral, we tell you before the referral is made.
  • Raising a concern. If you have a concern about a coach’s conduct, email [email protected] and senior leadership will follow it up personally. You can also raise it with the ICF through its ethical conduct review process.

4. The Coachability Portal

The Coachability Portal (at coachability.us/portal, including the Learning Portal, Coaching-On-Demand and our booking pages) is where you book sessions, work on goals and next steps, complete forms and agreements, follow learning programs and, for sponsoring organizations, follow progress.

  • Accounts are by invitation. We create your account for the role you have with us: client, coach, team member, sponsor or administrator. What you can see depends on that role, as described in our Privacy Policy.
  • Signing in. You may sign in with your email and password, with Google, or with a one-time code we email to you. Keep your sign-in details to yourself and tell us at [email protected] if you think someone else has used your account.
  • Public forms. Some forms open from a link and are unlocked with a one-time code sent to your work email. Anything you submit goes to the organization that shared the form and to Coachability.
  • Availability. We work to keep the portal available and secure, but it may occasionally be unavailable for maintenance or reasons outside our control.
  • Ending access. We may limit or close portal access when a program ends, when an organization’s agreement ends, or if these terms are broken.

5. Acceptable Use

When you use our website or portal, you agree not to:

  • share your account, or access another person’s account or information;
  • upload anything unlawful, harmful, or that you do not have the right to share;
  • copy, scrape or resell portal content, or try to break, probe or bypass its security;
  • share what other participants say in group sessions or workshops outside the session.

6. Your Responsibilities as a Client or Learner

  • Take part in scheduled sessions and complete the actions you agree with your coach.
  • Communicate honestly and openly with your coach.
  • Take responsibility for your own physical, mental and emotional well-being during and after the program.
  • Treat fellow participants, coaches and facilitators with respect for all backgrounds, perspectives and experiences.

7. Sponsoring Organizations

When an employer or other organization sponsors coaching or training:

  • Its sponsor team sees progress and participation as agreed in its contract and described in our Privacy Policy. The content of coaching conversations stays between the participant and their coach.
  • Sponsors who create forms in the portal decide what they ask and who they share the link with, and are responsible for having a valid reason to collect those answers. Coachability hosts the form and the answers for them.
  • Coaching-On-Demand credits provided by an organization are part of its program. Credits are used and expire as set out in the organization’s agreement, and the organization may add, move or withdraw them.

8. Scheduling, Cancellations and Rescheduling

Unless your agreement or your coach’s booking page says otherwise:

  • More than 48 hours before a session, you may cancel or reschedule.
  • Between 24 and 48 hours before, you may reschedule but not cancel.
  • Within 24 hours, the session can no longer be cancelled or rescheduled.

A missed session, or one cancelled late, counts as a session used. Individual coaches may set different notice periods; the rules that apply are shown when you book. Calendar invitations and video meeting links are sent by your coach.

9. Payment and Refunds

Fees are set out at enrollment or in your organization’s agreement, and are due on the schedule it specifies. Because our coaching and digital services are reserved and delivered for you, fees are non-refundable unless your agreement says otherwise.

10. Age Requirement

Our services are intended for people aged 18 and over, and are not directed to children. By using our website or portal you confirm that you are at least 18. If we learn that we hold personal information about someone under 18, we will delete it promptly.

11. Intellectual Property

All content, materials, workbooks, tools, methodologies, trademarks and branding on our website, in the portal and in our programs (including LeadIN™ – Leadership From Inside Out™ and Coachability Now™) belong to Coachability. You may use them for your own participation, but you may not reproduce, distribute or share them without our written consent.

12. Your Content

What you write in the portal, such as goals, wins, reflections, form answers and messages, remains yours. You allow us to store and process it only to provide our services to you and, where your program is sponsored, to produce the summaries described in our Privacy Policy.

13. Connected Services

Some features work with services you connect or that we rely on, such as Google (sign-in and Google Calendar) and Zoom (video meetings). Your use of those services is also governed by their own terms. You can disconnect optional connections at any time, as explained in our Privacy Policy.

14. AI Features

Some portal features, such as Enability AI for Coachability staff and coaches, use AI to summarize information and suggest next steps. AI output can be incomplete or wrong. It is a starting point for people to review, not professional advice, and it is never the only basis for a decision about you. How AI features handle data is explained in our Privacy Policy.

15. Disclaimer

The information on our website and in our programs is for educational and informational purposes only. It is not a substitute for professional medical, psychological, financial or legal advice. Your results depend on your own effort, commitment and circumstances.

16. Limitation of Liability

You agree that Coachability, its coaches and its contractors shall not be held liable for any direct, indirect, incidental or consequential damages, losses or expenses that may arise from your use of our services or participation in our programs. You acknowledge that your use of our services is at your own risk.

17. DMCA Policy

We respect the intellectual property rights of others. If you believe your copyrighted work has been copied in a way that is accessible on our website or portal, send our copyright agent a written notice under the Digital Millennium Copyright Act that includes:

  • a physical or electronic signature of the copyright owner or a person authorized to act for them;
  • identification of the copyrighted work and of the material you believe infringes it, with enough detail for us to find it;
  • your name, address, telephone number and email address;
  • a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and
  • a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner.

18. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any matter arising from these terms.

19. Changes to These Terms

We may update these terms to reflect changes in our services or the law. The Effective Date at the top shows when they last changed. When a change is significant, we will also let portal users know in the portal. Continuing to use our website, portal or services after a change means you accept the updated terms.
